Terms of Use

These terms (the "Terms", also our end user licence agreement) apply when you use the LivingTree app and this website. They are an agreement between you and LivingTree LLC (placeholder) ("we", "us"). By using LivingTree you agree to them. If you got the app from the App Store, Apple's Licensed Application End User License Agreement also applies; where the two differ, these Terms apply between you and us, and Apple's terms apply between you and Apple.

1. Not medical care

LivingTree is a self-care companion, not medical care. It doesn't diagnose, treat or replace professional help, and nothing in the app or on this site is medical advice. Information about recovery is general, may not apply to you, and is no substitute for a doctor.

Stopping alcohol or some drugs suddenly after heavy or daily use can cause serious withdrawal. Please talk to a doctor, or call SAMHSA's National Helpline (1-800-662-4357, free and confidential, 24/7), about stopping safely.

If you're in crisis, call or text 988 in the US (the 988 Suicide & Crisis Lifeline), or your local emergency number. Elsewhere, find a free helpline at findahelpline.com. Crisis lines in the app are always free to reach, whether or not you have paid.

2. The app and your data

You may use LivingTree for your own, personal, non-commercial use on Apple devices you own or control. What you write stays on your device and belongs to you; our Privacy Policy explains exactly what leaves it. Because your data lives only on your device, you are responsible for keeping a backup if you want one (Settings, Backup). We cannot recover data that was on a lost or erased phone.

3. Subscriptions and purchases

LivingTree is unlocked by one of these plans:

• Monthly, renewing every month;
• Yearly, renewing every year;
• Lifetime, a single one-time payment, not a subscription.

Prices are shown before you buy. Prices on our website and in the App Store differ (the App Store's are higher because Apple's fee is higher); you pay the price shown where you buy.

Automatic renewal. Monthly and yearly plans renew automatically at the end of each period, at the then-current price, until you cancel. For App Store purchases, payment is charged to your Apple account at confirmation, and renewal is charged within 24 hours before the end of the current period. There is no free trial.

Cancelling. Cancel at least 24 hours before the end of the current period to avoid the next charge. App Store: on your iPhone, Settings, your name, Subscriptions. Website purchases: the link in your receipt email. Cancelling stops future renewals; you keep access until the end of the period you paid for.

Refunds. App Store purchases are refunded by Apple under Apple's policies (reportaproblem.apple.com). For website purchases, write to support@livingtree.app. Where the law gives you a right to cancel and be refunded, nothing here limits it.

Restoring. Use Restore Purchases in the app (on the paywall or in Settings) to unlock a purchase on a new device or after reinstalling.

4. Acceptable use

Don't misuse the app: don't reverse engineer it except where the law allows, interfere with it, or use it to break the law.

5. Changes and availability

We may update the app, these Terms and our prices. We will give notice in the app or on this site of material changes. Price changes to an active subscription follow the store's rules and never apply to a period you have already paid for.

6. Disclaimers

The app is provided "as is". To the extent the law allows, we make no promises that it will be uninterrupted or error-free, or that it will produce any particular outcome for your health or recovery.

7. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of data stored on your device, and our total liability to you is limited to what you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

8. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, except where the law of your country of residence gives you protections that cannot be waived. [Placeholder pending legal review.]
